Resale right / Droit de suite

As of January 1, 2012, the resale right / droit de suite applies in the Netherlands. The resale right is the right of the creator of an original of a work of art, to receive a percentage of the sale price for any subsequent resale of that work.

Droit de suite or resale right is payable for the benefit of artists still living or their heirs until 70 years after the artist’s death. In accordance with Dutch laws and regulations, Auctionhouse Van Spengen will recover the statutory resale right fee from the buyer. Veilinghuis Van Spengen will take care of further financial settlement.

The resale right applies to works of art with a sale price (hammer price plus premium) above €3,000. If the resale right applies, this will be specifically mentioned at the lot concerned with the text: -this lot is subject to resale right-.

The amount of compensation is calculated as follows:

  • 4% of the portion of the sale price up to and including €50,000;
  • 3% of the portion of the sale price from €50,000.01 to €200,000;
  • 1% of the portion of the sale price from €200,000.01 to €350,000;
  • 0.5% of the portion of the sales price from €350,000.01 to €500,000; and
  • 0.25% of the portion of the sales price higher than €500,000 (with a maximum of €12,500)
