Terms and conditions of online bidding

In order for your participation in our online auctions to run smoothly, it is important to know our terms and conditions. These terms describe the rules and procedures to which all participants must adhere during the bidding process. We encourage you to read these carefully before you begin bidding. This way, you know exactly what to expect and avoid any misunderstandings.

Van Spengen
  • Bidding in our Timed-Online auctions is only possible after registration through our website.
  • You are advised to make your registration no later than 24 hours prior to the auction. This is because your registration needs approval and processing time.
  • The auctioneer always excludes any liability regarding the failure of a registration and/or bid to succeed for whatever reasons.
  • It is impossible for the buyer to place a bid without having previously agreed to the terms and conditions.
  • The auctioneer always excludes any liability for the technical operation accessibility of the website.
  • The auctioneer at all times has the right to refuse or undo a bid.
  • If another bid is placed on an item within 3 minutes before the closing time of a lot, the closing time will be extended to 3 minutes.
  • The auctioneer shall record the personal data obtained by it in records kept for that purpose.
  • By registering on the website, the user gives the auctioneer permission to use and store the registered data.
  • The auctioneer will use this data only for its own use. In addition, the auctioneer is authorized to provide this information to the seller and any auxiliary persons of the auctioneer and the seller. The auctioneer will not provide these data to other third parties without the user’s consent, except for the auctioneer’s obligation to do so under any statutory provision or by order of the competent authority. In the event of negligent payment by the buyer, the auctioneer shall be entitled to transfer these records to a judicial power and/or power with the authority to collect the negligent payment by other means.
  • The user guarantees the accuracy and completeness of the information and data provided by the registration. Should these data change at any time, the user is obliged to inform the auctioneer of these change(s) by return of post. If the user fails to do so, the auctioneer is entitled to charge the user €25 in administrative costs.
  • Bids submitted are binding and exclusive of 29% buyers’ premium / commision. This means that placing a bid in an auction through your account (by you or by another person using your account) cannot be withdrawn and you are therefore validly / legally bound. If your bid is successful, a contract is automatically established when the auction closes.
  • The buyer is deemed to have purchased for himself and is liable for payment without relying on a principal.
  • Lots will be sold as shown on the website. If any defects are not shown in the form of a written notice or photograph on the site, the buyer can assume that the item will be delivered to him as shown. If the catalog mentions certain defects or imperfections, this is intended to be an indication that is not exhaustive and from which the buyer cannot derive any rights. The buyer has a duty of inquiry and all items offered are available for viewing on viewing days prior to the auction.
  • The auctioneer cannot be held responsible for the technical operation of clocks, watches, timepieces and electrical appliances. These are offered with no guarantee of efficacy.
  • All objects are sold in the condition they are in as delivered, “as is”.
  • Any shipping of purchased goods is at your own responsibility (see also shipping).
