Personal data we process

Your personal data is processed because you use our services and/or because you have provided it to us yourself. Below is an overview of the personal data we process:

• Gender
• Date of birth
• Birthplace
• Company
• Address
• Phone number
• Email address
• Message information from website or email
• Bank account number / IBAN number

Special and/or sensitive personal data we process

Our website and/or service does not intend to collect data on website visitors who are under the age of 16. Unless they have parental or guardian consent. However, we cannot verify whether a visitor is older than 16. We therefore recommend that parents be involved in their children’s online activities in order to avoid collecting data about children without parental consent. If you believe that we have collected personal information about a minor without such consent, please contact us at info@vanspengen.com and we will delete this information.

For what purpose and on what basis we process personal data

Veilinghuis Van Spengen processes your personal data for the following purposes:

• Entering into agreements with respect to the services we provide and performing them.
• To contact you as needed to perform our services
• To pick up or deliver goods and services to you
• Informing you about our auctions and relationship management
• Registering you as a buyer and for bidding in our (online) auctions
• Registering bids and purchases
• Handling payments
• Registering and executing contributions and sales in auction
• Disbursing sold / consigned goods.
• Informing you of changes to our services
• Shipping of consigned or purchased items
• Sending information/newsletters about our services
• Contractual or legal obligations

How long we keep personal data

Van Spengen does not retain your personal data longer than is strictly necessary to fulfill the purposes for which your data is collected. But at least during the retention periods as determined by Dutch law and as much longer as necessary to provide good service. For valuation reports we use a retention period of at least 10 years, unless otherwise agreed with the client (in accordance with the Federation of TMV Code of Conduct and Professional Rules).

Sharing personal data with third parties

Veilinghuis Van Spengen only and exclusively provides your data to third parties if this is necessary for the execution of the agreement with you, or to comply with a legal obligation.

Payments

For (international) payments, we may use third-party payment services including Mollie, Wise and Worldline.

AML policy / Wwft

Client screening and reporting obligation
The Money Laundering and Terrorist Financing Prevention Act (Wwft) states that banks and institutions must prevent money laundering through their systems. The Wwft applies to institutions and professions that deal with money flows or the purchase and sale of goods. As a result, the auctioneer is required under the Wwft to conduct customer due diligence, so-called Know Your Customer (KYC).

To do this, we must, among other things, establish who the customer is, verify that the customer represents someone, find out who the ultimate beneficial owner (UBO) is. To do this, we need to establish your identity through a valid proof of identity. In addition, the auctioneer is obliged to report unusual money transactions that could be related to money laundering or the financing of terrorism to the Unusual Transactions Disclosure Office (FIU-Nederland). This also applies to a proposed transaction that is not (yet) executed.

Therefore, auction house Van Spengen prefers to receive payments by bank. Cash payments -are possible in certain cases- and can only be accepted according to current rules and legislation.

Website visit | Cookies or similar techniques we use

Veilinghuis Van Spengen uses cookies with purely technical, functional and analytical functionality. We do not use marketing and/or tracking cookies. The functional cookies do not invade your privacy and ensure that the website works properly and that, for example, your preferences are remembered. These cookies are also used to make the website work properly and to optimize it. During your first visit to our website, we have already informed you about these cookies and asked your permission to place them. You can opt out of cookies by setting your Internet browser to no longer store cookies. In addition, you can also delete any information previously stored via your browser settings.

Google / Google Analytics

In order to analyze and track how users use our website, we use Google Analytics. On your first visit to our website, you will be asked to consent to the installation/use of cookies from Google Analytics. The information thus obtained (e.g. your IP address) is stored on Google servers. Our website links to Facebook, Instagram, YouTube and LinkedIn. You can use the buttons on the website to promote and/or share our website. Auction House Van Spengen is not responsible for the privacy policies of these channels, as they themselves determine how these buttons function. When using these channels, a cookie may be placed, among other things. The privacy policies of the channels change regularly, the privacy statements of the relevant Social Media channels can be found online, here you can gain insight into how these third parties handle your personal data.

Newsletter

We keep our clients informed through (electronic) newsletters. With this we want to inform visitors of our website and other interested parties about news and upcoming auctions of Veilinghuis Van Spengen. You will only receive this newsletter if you have given your explicit permission. Each newsletter includes the option to unsubscribe.

Cameras

To protect your and our property and the safety of our customers and staff, we use visible and possibly invisible security cameras in and around our auction building. If any abuses are observed, we will share these images – in accordance with laws and regulations – with the police, judicial authorities and third parties.

View, modify or delete data

You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your possible consent for data processing or object to the processing of your personal data by Veilinghuis Van Spengen and you have the right to data portability. This means that you can request us to send the personal data we hold about you in a computer file to you or another organization named by you. You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your consent or objection to the processing of your personal data to info@vanspengen.com. To make sure that the request for inspection is made by you, we ask you to send a copy of your proof of identity with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks. Van Spengen would also like to remind you that you have the opportunity to submit a complaint to the national supervisory authority, the Authority for Personal Data. Security

Veilinghuis Van Spengen takes the protection of your data seriously and takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you have the impression that your data is not properly secured or there are indications of misuse, please contact us at info@vanspengen.com. Veilinghuis Van Spengen has taken the following measures to secure your personal data:
– TLS (formerly SSL) We send your data over a secure internet connection. You can tell this by the address bar ‘https’ and the padlock in the address bar.

Legal or contractual obligation

Veilinghuis Van Spengen may request and process specific/additional personal data from you on the basis of a legal obligation or in performance of an agreement (e.g. submission of a copy of ID proof, declaration of execution, declaration of ownership, power of attorney, property or vehicle registration certificate). The person(s) from whom this data is requested and processed is obliged to provide this data. Failure to provide this data may result in the assignment being returned or the service/contract being terminated.

Changes/Adjustments Privacy Policy.

Veilinghuis Van Spengen reserves the right to add to or change the privacy policy at any time. We therefore advise you to consult the privacy statement regularly.
